Attorney General classifies Agyapa derivative deal as likely unconstitutional

[] — The Attorney General and Minister of Justice, Ms. Gloria Akuffo has described the Agyapa deal as “unconscionable”. According to her, the deal goes against the Bank of Ghana Act, 2016 (Act 918) which stipulates that transactions be made in the currency unit of Ghana which is the cedi or its equivalent.

In a leaked letter, Ms. Akuffo stated that the deal renders any court of the land helpless in pronouncing on any aspect of the deal and it therefore “freezes anything legal including judicial orders and decisions.”

Ghana’s Minister of Justice via the leaked letter inferred that the deal is an interference of the powers of the judiciary. The deal in her opinion is also in contravention of separation of powers.

The Agyapa deal has already been passed by parliament. The minority has called for a withdrawal of the deal.
